The "tartan - ribbon . com" web site is designed as an introduction to some of the products and services offered by Cake Stuff Ltd (hereafter referred to as “The Company”).
Permission is granted to electronically copy and to print in hard copy portions of this web site for the sole purpose of placing an order with The Company or using this web site as a shopping resource. Any other use of materials on this web site including reproduction for purposes other than those noted above, modification, distribution, or republication without the prior written permission of The Company is strictly prohibited.
All designs shown on the web site are protected by international copyright and ownership in the design lies with the designers and/.or manufacturer of the particular design in question. It is an offence to copy any of these designs and the owners reserve the right to use both the criminal and civil law to protect their rights. Most designs shown are owned by members of ACID (Anti Copying In Design) who actively prosecute anyone illegally copying members’ designs. For the avoidance of doubt, Scots law applies at all times.
Product and company names mentioned on this web site may be the trademarks or registered trademarks of their respective owners. Their use is protected by international copyright law.

Colours / Designs
Colours and designs shown on the web site are representative only and The Company offers no guarantee of precise colour or design match, due to the limitations of photography and conditions outwith The Company’s control such as reproduction of images on The Customer’s PC.
The historic nature of tartan means various weavers hold their own catalogues of designs and thread dyes. For this reason, it is perfectly normal for one weaver's version of a tartan to look different from another's. This applies to orders for Wool Plaid Tartan Ribbon where The Company advises The Customer to double-check the image shown against that shown on the Scottish Tartans Authority website or similar authorative source prior to ordering. Please note The Company guaranees to supply the cotrrect tartan although this, on very rare occasions, may differ from the image shown.
Manufacturing variations in colour, design, material, length, width and presentation are to be expected although the Company guarantees that no such variations will affect the quality of the product nor shall any variation in length or width contravene the Sale of Goods Act.
The Company reserves the right to change prices without notice and especially for non-UK customers, where a currency conversion is required. International exchange rates vary on a daily basis and the price charged may vary slightly from the price advertised due to Nochex, PayPal and Zen-Cart software offering different exchange rate calculations.
For example: a non-UK customer paying by Nochex accepts Nochex’s exchange rate as part of the terms and conditions of using Nochex. This exchange rate may be slightly different from that used to calculate the advertised product price.

All prices include VAT where applicable. This web site automatically deducts VAT from orders placed by customers outside the European Union. Customers within the EU zone are charged VAT at the current UK rate. Customers within European territories with special VAT rules (eg Jersey) are still charged VAT and, in most cases, can apply for refund of VAT from the tax authorities at point of delivery. Sorry - there are just too many rules and exceptions for the web site to automatically handle every possibility.
The products shown on this web site are also sold by The Company through a physical showroom, by mail-order and by other on-line methods. Stock availability shown on the web site cannot be guaranteed and The Company reserves the right to cancel any orders where despatch cannot be fulfilled within 5 working days and/or new stock is not expected to arrive right away.
Although rare, an item(s) may become out-of-stock, in which case The Company reserves the right to ship all available parts of the order and, at its sole discretion, to ship the balance or refund the balance to The Customer. The Company will attempt to notify The Customer and offer The Customer the option of a back-order or refund. The Customer is asked to note that orders are not accepted upon a “conditional” basis - The Company has the right to ship whichever parts of an order are available without The Customer having the right to cancel the rest of the order. The shipping costs of any back order(s) will be covered by The Company.
The Company “ships on behalf of The Customer”. The Company offers worldwide shipping on all orders but the contract for delivery on orders shipped outside the EU rests between The Customer and Royal Mail or the shipping company chosen by The Customer.
For smaller and international orders, The Company ships (posts) via Royal Mail on weekdays only.
For larger orders, The Company ships via APC Overnight carriers on weekdays only.
The Company reserves the right to ship orders of certain values or to certain destinations (including international destinations) by Royal Mail Signed For or any other enhanced delivery service it deems appropriate.
The Company is bound by all relevant UK legislation including, but not limited to, the Sale of Goods Act and Distance Selling Regulations but emphasises that The Company is not liable for any loss or damage to orders in shipping. Should an order be lost or damaged, The Company will provide details for The Customer to claim against the shipping company. The Company offers upgraded shipping options and highly recommends these as they offer on-line tracking facilities.
Non-UK customers are reminded that Air Mail does not offer an on-line tracking facility and that Royal Mail requires 21 working days before they will consider an item lost. The Company recommends the use of Airsure© or International Signed For© to countries where these services are available. In all cases the Terms and Conditions of Royal Mail or shipping company apply.
The Company endeavours to ship all orders, stock permitting, within 48 hours of payment being made but this is not guaranteed due to weekends, public holidays etc. The Company will ship all orders within 5 working days.
As per Shipping above, The Company “ships on behalf of The Customer”. The Company offers worldwide shipping on all orders but the contract for delivery rests between The Customer and Royal Mail or the shipping company chosen by The Customer.
The Company respectfully points out that The Customer is responsible for ordering in sufficient time and that as the contract for delivery rests between The Customer and Royal Mail or the shipping company chosen by The Customer, The Customer should be fully aware of Royal Mail stated delivery times (www.royalmail.com) . . .
2nd class: Royal Mail state they try to deliver most items of 2nd class mail within 3-5 working days after date of posting.
1st class: Royal Mail state the try to deliver most items of 1st class mail within 1-3 working days after date of posting.
Signed For: this additional tracking service does not speed up delivery, it simply makes delivery more secure. A signature is required on delivery.
Special Delivery: Royal Mail guarantee to deliver Special Delivery items by 1pm on the next working day after the date of posting.
APC Overnight Carriers: for larger orders within the UK mainland, The Company uses APC Overnight. Delivery is normally within 48 hours of despatch, but allow up to 3-5 working days for remote addresses.
Air Mail: Royal Mail state that Air Mail items being posted within Europe normally take 3-5 working days. For Italy, please allow 7-10 working days. For all other countries, Royal Mail state that Air Mail items normally take 7-10 working days. In all cases, Royal Mail deliver to point-of-entry to the country in question and final delivery to The Customer is handled by the domestic postal service of that country. Delays at customs or caused by the domestic postal service are not the responsibility of The Company. Royal Mail do not consider an Air Mail item late or lost for 21 working days after date of posting.
Airsure & International Signed For: Airsure and ISF are slightly faster international delivery services with limited on-line tracking. Royal Mail state that AS / ISF items being posted within Europe normally take 2-5 working days. For Italy, please still allow 7-10 working days as Poste Italianne is infamously slow. For all other countries, Royal Mail state that Air Mail Airsure & International Signed For items normally take 5-7 working days. In all cases, Royal Mail deliver to point-of-entry to the country in question and final delivery to The Customer is handled by the domestic postal service of that country. Delays at customs or caused by the domestic postal service are not the responsibility of The Company. Royal Mail do not consider any Air Mail item late or lost for 21 working days after date of posting.
For UK non-business customers, The Company will accept returns of most items* up to 14 days after date of delivery in line with the Distance Selling Regulations and other statutory obligations. Please contact The Company direct within 7 days of delivery to arrange returns. The Customer will be given a returns code. Items returned without such a returns code cannot be processed for refund.
*personalized/customized goods and items produced specifically for The Customer (eg Wool Plaid Tartan Ribbon or ribbon cut from 25m reels - ie 5m top up packs) are exempt from the returns policy. This does not affect The Customer's statutory rights.
If goods are supplied incorrectly or are faulty, The Company will accept returns and will replace or refund as The Customer prefers, providing The Customer with a pre-paid return postage label or reimbursing the customer any reasonable return P&P costs. In this instance “reasonable” is deemed to be as using the same or comparable service as used for shipping the original order and must be correct - ie if the item(s) can be posted Royal Mail Large Letter but The Customer packs / sends as Royal Mail Small Packets, then The Company reserves the right to refund the correct Large Letter postage rate only. The customer is responsible for the safe return of the item(s).
Non-UK customers and business customers should contact The Company for information on returning an order. In all cases a returns code is required before any item(s) can be returned.
Where the goods are correct but The Customer changes their mind, The Customer (UK retail customer only) can exercise their right under the Distance Selling Regulations to return goods which are not as expected. The Customer must contact The Company within 7 days of receipt of the order and return the goods within 14 days of receipt of the order. The Customer will be given a returns code. Items returned without such a returns code cannot be processed for refund. Products which are exempt from the Distance Selling Regulations include edible / perishable prdocts, personalized / customized goods and items produced specifically for The Customer - in the case of tartan ribbon this means that Wool Plaid Tartan Ribbon or ribbon cut from full 25m reels (5m top up packs) are not covered. This does not affect The Customer's statutory rights.
The Company will only accept return of goods which remain in original packaging and which arrive at The Company’s offices in “as new” re-saleable condition. Once the item is received The Company will refund the value of the goods including original standard P&P, where applicable. The Customer is responsible for return postage costs and The Company may be able to offer a downloadable pre-printed postage label which costs The Customer less to use than by posting from a Post Office counter or by using other Royal Mail services.
The cost of using the returns postage label will be agreed with The Customer when The Customer contacts The Company to arrange returning the item(s) and The Customer will be given a returns code at the same time. By proceeding to order from The Company, The Customer authorises The Company to charge their debit / credit card automatically the agreed amount.
The only portion The Company cannot refund is where an additional service has been paid for - an example being faster shipping. So, for example, if The Customer chooses 1st class Signed For or Special Delivery and then returns the order, The Company will refund the value of the order but not the Special Delivery charge as this is an additional service.
Timescale is entirely the responsibility of The Customer. The Company offers a range of shipping options and ensuring sufficient time for the order to arrive and to be replaced if necessary is solely the responsibility of The Customer.
